Identify Eyewitness Recollection in criminal cases. Discuss the impact of misidentification.


Watch the following videos (1 and 2) and identify how eyewitness recollection affects criminal cases. The following is a very interesting demonstration in eyewitness recollection. Answer questions that follow.

This is very interesting for us in a number of ways.  While on the surface it appears to challenge eyewitness reliability generally, what it really seems to challenge is an eyewitness’s reliability as to being able to recall everything that occurred during an event, especially a traumatic one, or one where the victim’s attention is focused on a particular person or thing.   

It helps explain why a robbery victim, who is concentrating on the robber, may not see other things going on during the robbery that we know were happening and cannot understand why the witness does not remember seeing that particular thing happening.  This is not a bad thing if the issue is the reliability of the witness.
